Terms of Service (Taiko)

These Terms of Service (“Terms”) govern your access to and use of the Taiko website (the “Site”) and any purchases made through the Site. In these Terms, “Taiko,” “we,” “us,” and “our” refer to Miyuki Design, registered in The Netherlands, with its registered office at Piet Paaltjensstraat 26, 2522VH, Den Haag, Chamber of Commerce (KvK) number 94873291.
By using our Site or placing an order, you agree to these Terms.
1) Eligibility
You must be at least 18 years old (or the age of majority in your country) to place an order. If you are under 18, a parent or legal guardian must place the order for you.
2) Accounts (if applicable)
You may create an account to access certain features. You are responsible for:

keeping your login credentials secure, and
-
all activity under your account.
We may suspend or terminate accounts that violate these Terms.
3) Products and Availability
We try to display product descriptions, sizing, colors, and images as accurately as possible. However:

colors may vary due to screen settings,

minor variations can occur between production batches, and
-
availability may change without notice.
We reserve the right to limit quantities, discontinue products, or update product details at any time.
4) Pricing and Payments
We reserve the right to change prices at any time. Price changes do not affect orders already confirmed and paid.
Payment must be completed at checkout using the payment methods offered on the Site. If a payment is reversed or invalid, we may cancel your order.
5) Orders, Confirmation, and Cancellation
When you place an order, you are making an offer to buy. Your order is only accepted once we send an order confirmation and/or dispatch confirmation.
We may refuse or cancel orders in cases including (but not limited to):

suspected fraud or unauthorized transactions,

incorrect pricing or product information due to error,

stock unavailability, or
-
repeated policy abuse (e.g., excessive returns).
If we cancel after payment, we will refund you to the original payment method.
6) Shipping and Delivery
We ship to the destinations offered at checkout. Delivery times are estimates and not guaranteed.
Ownership and risk of loss pass to you upon delivery (or, where legally required, as determined by applicable consumer law).
You are responsible for providing accurate shipping information. If a parcel is returned due to an incorrect address or failed delivery attempts, we may charge additional shipping fees to resend it.
7) Returns and Refunds
Returns are governed by our Return Policy, which is incorporated into these Terms by reference. Please review it before purchasing.
Key points (summary only; the Return Policy controls):

Returns must be requested within 30 days of delivery.

Items must be returned unworn beyond fitting, unused, and unwashed, with tags and original packaging.

Items showing signs of wear beyond fitting, washing, stains, odors, alterations, or damage may be refused and not refunded.

Sale items and gift cards are non-returnable (unless required by law).
8) Promotions and Discount Codes
Discount codes:

must be applied at checkout and can’t be added retroactively,

may have exclusions and expiration dates,
-
may be cancelled if used improperly.
We may change or withdraw promotions at any time.
9) Intellectual Property
All content on the Site—including logos, designs, graphics, images, product names, text, and the Site’s look and feel—is owned by or licensed to Taiko and is protected by intellectual property laws.
You may not copy, reproduce, distribute, modify, or create derivative works without our written permission.
10) User Content (Reviews, Comments, Submissions)
If you submit content (e.g., reviews, photos, comments), you represent that you own it or have permission to submit it.
You grant Taiko a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, publish, display, and adapt your content for marketing and business purposes (e.g., on the Site, email, ads, or social media), unless prohibited by law.
We may remove content that violates these Terms or is inappropriate.
11) Prohibited Use
You agree not to:

use the Site for unlawful purposes,

attempt to gain unauthorized access to the Site or systems,
-
introduce malware or engage in scraping/automated access without permission,
-
submit false, abusive, hateful, or misleading content,
-
infringe on intellectual property or privacy rights.
We may restrict access for violations.
12) Disclaimer of Warranties
To the fullest extent permitted by law, the Site and products are provided “as is” and “as available.” We do not guarantee that:

the Site will be uninterrupted or error-free, or
-
product images and colors will display identically on all devices.
Nothing in these Terms limits any mandatory consumer guarantees under applicable law.
13) Limitation of Liability
To the fullest extent permitted by law, Taiko will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, or data.
Where liability cannot be excluded, our total liability will be limited to the amount you paid for the relevant order, except where mandatory law requires otherwise.
14) Indemnification
You agree to indemnify and hold Taiko harmless from claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Site, or violation of any law or third-party rights.
15) Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how we collect and use personal data.
16) Changes to These Terms
We may update these Terms from time to time. The “Last updated” date will reflect the latest version. Continued use of the Site after changes means you accept the updated Terms.
17) Governing Law and Disputes
These Terms are governed by the laws of the Netherlands, excluding conflict-of-law rules.
If you are a consumer in the EU/EEA, you may also have mandatory rights and protections under your local consumer laws that cannot be waived.
Disputes should first be raised by contacting us so we can try to resolve them informally.
